(2) The Landtag shall exercise legislative power, supervise the exercise of executive power in accordance with the
provisions of this Constitution, and be a forum for the formation of political opinion.

(3) The deputies represent the whole people. They are subject only to their conscience and are not bound by
orders or instructions.
Article 40
[Parliamentary opposition]

1 The right to form and exercise parliamentary opposition is essential to liberal democracy. Parts of the Landtag not
supporting the government have the right to equal opportunities in the Landtag and in public.
Article 41
[Electoral system, eligibility]

(1) As a rule, the Landtag consists of 120 deputies. They are elected according to a procedure that combines
personal election with the principles of proportional representation.

(2) All eligible voters can vote. Eligibility may be made conditional on a certain period of residence in the country.
(3) The details shall be determined by law.
Article 42
[Candidacy, claims of deputies]
(1) A person running for a seat in the Landtag is entitled to the leave necessary to prepare for his or her election.

(2) No person shall be prevented from assuming and holding the office of Member of Parliament. Termination or

dismissal from a service or employment relationship for this reason is inadmissible.

(3) Members of parliament shall be entitled to appropriate compensation that safeguards their independence.
2 You have the right of free use of all state transportation within the country.
(4) The details shall be determined by law.
Article 43
[Acquisition and loss of the mandate]

(1) A person elected as a Member of the Landtag shall acquire his or her mandate upon acceptance of the
election, but the legal status of a Member of the Landtag shall not be acquired before the new Landtag convenes.
2 Acceptance of the election may be refused.

(2) Members of the Landtag can renounce their mandate at any time. The waiver shall be declared in writing to
the President of the Landtag. The declaration is irrevocable.

(3) If deputies lose their eligibility, their mandate shall expire.
Article 44
[Election period, meeting, convocation]

(1) The Landtag is elected for a five-year term. Its term of office ends when a new Landtag convenes. This shall
also apply in the event of the dissolution of the Landtag.
(2) The new election must take place before the end of the electoral period, in case of dissolution of the Landtag
within sixty days.
(3) The Landtag shall convene no later than the thirtieth day after the new election. The first session shall be

convened by the age president and presided over until the election of the president of the Landtag.

(4) The Landtag shall determine the closing and resumption of its sessions. The president may convene the
Landtag earlier. He is obliged to do so if a quarter of the members of the Landtag or the state government

requests it.
Article 45
[Election review]

(1) The electoral review is a matter for the Landtag. It also decides whether a member has lost his or her
