Constitution





                                           [Constructive vote of no confidence]

             (1)  The Landtag may withdraw its confidence from the Prime Minister only by electing a successor by a majority of
             its members.
             (2)  There must be at least three days between the request for dismissal and the election.

                                                       5.  Section
                                                       Legislation

                                                        Article 70
                                        [Legislative initiative, resolution of the laws]
             (1)  Bills are introduced by the state government, from among the members of the Landtag, or by the people
             through popular petition.
             (2)  Laws are passed by the Landtag or directly by the people through referendum.

                                                        Article 71
                                                    [Popular motion]

             (1)  All those eligible to vote in the country have the right to initiate a popular motion.  It must be supported by the

             signatures of at least 40,000 voters.  It must be based on a draft law accompanied by a statement of reasons.

             (2)  The popular motion shall be submitted to the president of the Landtag.  It shall decide on admissibility without
             delay after obtaining the opinion of the state government.  If it considers the popular motion unconstitutional, the

             constitutional court shall decide on its application.  The popular motion shall not be treated as inadmissible until a
                                                       4
             decision to the contrary is made.
             (3)  The president of the Landtag shall publish the admissible popular motion with reasons.
             (4)  The Landtag shall give the applicants an opportunity to be heard.

                                                        Article 72
                                                 [Referendum, plebiscite]

             (1)  If the Landtag does not approve the unamended petition within six months, the petitioners may initiate a
             petition for a referendum with the aim of bringing about a referendum on the petition.  The petitioners may base

             the referendum on a bill that has been amended in comparison with the petition.  In this case, Article 71 paragraph

             2 shall apply mutatis mutandis.

             (2)  A referendum shall be held if at least 450,000, but not more than 15 per cent, of those entitled to vote support

             the referendum petition by their signatures.  At least six months must be available for support.  The Landtag may
             attach its own bill to the referendum.

             (3)  Between a successfully completed referendum petition and the referendum, there must be a period of at least
             three and not more than six months for public information and discussion of the subject matter of the referendum.
             2 This time limit may be subceeded or exceeded only with the consent of the applicants.

             (4)  The referendum is a yes or no vote.  The majority of the valid votes cast shall be decisive.

                                                        Article 73
                            [Inadmissibility of popular motion, petition and decision, repetition]
             (1)  There shall be no referendum, referendum petition or referendum on tax, salary or budget laws.
             (2)  A petition for a referendum that has been rejected by a referendum may be restarted at the earliest after the
             expiration of the legislative period of the Landtag.
             (3)  The details of the popular motion, the petition for a referendum and the referendum itself shall be determined
             by a law, which shall also determine the entitlement to reimbursement of the necessary costs of organizing the
             petition for a referendum and an appropriate campaign for the referendum.

                                                        Article 74
                                             [Amendment to the Constitution]

             (1)  The Constitution may be amended only by law expressly amending or supplementing the text of the

             Constitution.  The amendment shall not contradict the principles of Articles 1, 3, 14 and 36 of this Constitution.
